Podcast Guest Agreement & Release

*By submitting this form, you are agreeing to our Podcast Guest Agreement and Release.

This agreement is governed by the laws of New South Wales, Australia, and the Copyright Act 1968 (Cth). Please read this agreement carefully before signing. If you have any questions, contact the Producer before completing this form.

1 Grant of Rights
I, the undersigned Guest, hereby consent to and grant to the Producer of Sydney Strength Coach (the "Program") a perpetual, worldwide, royalty-free licence to:

• Record my voice, image, photograph, likeness, and performance as part of my participation as a guest on the Program;

• Use, reproduce, edit, broadcast, publish, stream, and distribute the recording(s) of my appearance in any and all media formats and modes of transmission, whether now known or developed in the future, throughout the world, in perpetuity;

• Promote the Program using my name, voice, and likeness in advertising and promotional material, provided this does not imply my endorsement of any third-party product or service without my separate written consent.

Under the Copyright Act 1968 (Cth), the Producer shall be the sole owner of copyright in the Program and all associated materials ("Materials") produced in connection with my appearance.

2 Moral Rights
I acknowledge that I may have moral rights in my contribution under Part IX of the Copyright Act 1968 (Cth), including the right of attribution and the right of integrity. To the extent permitted by law, I hereby:

• Consent to the Producer attributing, or omitting attribution of, my contribution as the Producer sees fit for production purposes; and

• Consent to any reasonable edits, adaptations, or modifications to my contribution that may otherwise constitute an infringement of my moral rights, provided the Program is not used in a way that is seriously prejudicial to my honour or reputation.

3 Compensation
I acknowledge and agree that I will receive no financial compensation for my appearance on and participation in the Program, unless separately agreed in writing.

4 Editorial Control
I acknowledge that the Producer has sole editorial discretion over the content, editing, and final form of the Program and Materials. I waive any right to review, approve, or request changes to the Program prior to its publication or distribution, except where required by law.

5 No Obligation to Publish
Nothing in this Agreement obligates the Producer to publish, distribute, broadcast, or otherwise use my appearance or any Materials. The Producer retains full discretion over whether to release the Program.

6 Privacy
The Producer will collect your personal information (including your name, image, and contact details) solely for the purposes of producing and promoting the Program. This information will be handled in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Your personal information will not be disclosed to third parties without your consent, except as required by law or where necessary for the distribution of the Program (e.g., podcast hosting platforms).

7 Release From Liability
To the extent permitted by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) and other applicable laws, I release and discharge the Producer, their employees, agents, successors, and assigns from any and all claims, demands, or liability arising out of or in connection with the recording, editing, production, distribution, or publication of the Program and Materials.Nothing in this clause limits any rights I may have under the Australian Consumer Law or any other non-excludable statutory guarantee.

8 Warranties
I represent and warrant that:

• I am 18 years of age or older and have full legal capacity to enter into this Agreement;

• I am not subject to any existing agreement or obligation that would prevent me from granting the rights set out in this Agreement;

• My participation in the Program does not infringe the intellectual property, privacy, or other rights of any third party;

• Any statements I make during the Program are true and accurate to the best of my knowledge, and do not constitute defamation.

9 Governing Law
This Agreement is governed by and construed in accordance with the laws of New South Wales, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of New South Wales.

10 Electronic Signature
By typing my full name below and submitting this form, I confirm that:

• I have read and understood the contents of this Agreement;

• I am entering into this Agreement voluntarily and of my own free will; and

• I agree to be bound by its terms.
